If any person involved in the accident is injured and requires immediate medical treatment away from the scene, AND the CMV driver receives a citation for a moving traffic violation arising from the accident — post-accident testing is required. Both conditions (injury requiring off-scene treatment AND citation) must be present.
If any motor vehicle involved in the accident incurs disabling damage and must be transported away from the scene by a tow truck or other vehicle, AND the CMV driver receives a citation for a moving traffic violation arising from the accident — post-accident testing is required. If an accident does not meet any of the three conditions above, DOT post-accident testing is not required. However, employers should document the accident, the assessment of whether testing was required, and the reasoning for not testing.
